Doubt not enough to avoid summary judgment
An argument that a jury could disbelieve uncontradicted testimony offered by an opposing party is not sufficient to raise a genuine issue of material fact and avoid summary judgment, a federal District Court in Pennsylvania has held. The party opposing the judgment must present evidence or point to circumstances in the record that might cause a reasonable jury to doubt the testimony.
