Baby’s exposure to HIV is not a disability

A baby who was “exposed” to HIV before birth but is HIV negative after birth is not “disabled” under the standards of the Americans with Disabilities Act or the New York City or state human relations laws, a Federal District Court has held. A parent coordinator for a nonprofit community organization providing child and family support services was terminated after being late or leaving early on 18 of the 35 workdays in March and April, 2010, and missing work entirely on 13 more.
