Political party is not ‘unincorporated nonprofit association’

A political party is not an “unincorporated nonprofit association” under the law of Ohio, an appellate court has affirmed. The issue arose when several members of the state Republican Party sued several leaders of the Party on a variety of claims, including misappropriation of funds and breach of contract for improperly removing them from committees. A trial court dismissed the case for failure to state a claim on which relief could be granted. The trial court said the claims were not justiciable because they involved the internal workings of a political party, or even if they were justiciable, none of the claims was supported by applicable law.
