A complaint for discrimination filed by a blind former employee of a nonprofit providing services for people with disabilities has been dismissed when the former employee did not apply for the new job. Ray Justus had been laid off from his position as a community action specialist when his job was eliminated for lack of funding. He had been invited to apply for another position a few months later, but was not hired when that position was also cut for lack of funding.
