Inadequate disclosure voids waiver of judicial remedies
The Sixth Circuit Court of Appeals has reversed a trial court decision that a husband and wife couple had knowingly and voluntarily waived their right to judicial relief in employment disputes and remanded their wrongful discharge claims for further hearing. The employees had signed an employment application that specifically stated that they waived judicial relief and agreed to accept the decisions of an internal grievance procedure. The husband was terminated for lying about attending Army National Guard training and testing positive for drugs while at work.
