Who owns the right to name of Golden Acres?

Who owns the right to the name of Golden Acres as a home for the elderly when the name was specifically excluded from transfer under an Asset Purchase Agreement but included in the Bill of Sale signed by the seller at closing?

The Dallas Home for Jewish Aged contested the use of the Golden Acres name by the purchaser of the property.  The purchaser sought a declaratory judgment that it owned the right to the name.
