Investigation by private detective is grounds for constructive termination
An employee of a healthcare organization who was investigated by a private detective after filing an age discrimination complaint “provides more than a sufficient basis for a finding that the workplace became so intolerable that a reasonable person would feel compelled to resign,” a federal District Court in Pittsburgh has ruled. The Court has permitted the employee to continue with claims of age discrimination and retaliation. The employee was hired as a maintenance employee in 1993 and promoted to director of facilities in 1996.
